Dispute Resolution through Legal Mediation

Did you know that you can dispute resolution through legal mediation? The mediator acts as a neutral representative between the two disputing parties and they help both sides reach an agreement that satisfies everyone involved. They’re basically the voice of reason that helps to sort everything out so a solution can be found.

If you’ve never heard of legal mediation before you’re not alone. There are many people who do not know about these services and the legal system would like to keep it that way. After all, if more people knew about mediation, they wouldn’t be paying lawyers a high fee to represent them in a court of law.

When you hire a lawyer and take your case to civil court, you’re paying him or her by the hour. They benefit by dragging out the case and making it last as long as possible. Therefore, some cases are dragged out for months when they could have been settled in just a few days or weeks. Eventually, one side will be deemed the winner but in the end, most people are not completely happy with the outcome.

Legal mediation works in a completely different way. It’s not intended to determine who the winner is and who the loser is. Instead, the mediator negotiates with both parties until an agreement can be reached that is mutually accepted by both parties. There is no winner or loser and both parties can feel as if they were treated fairly.

In most disagreements the parties involved usually know what’s fair and what’s not. Nevertheless, they can’t seem to reach a compromise that is accepted by both sides without some type of intervention. That is what the mediator does. They are the unbiased party that goes between the two sides and helps them reach an agreement that will make both parties happy.

If you take a few minutes and think about it, there is no communication between the two opposing sides when lawyers are hired and these civil cases go to court. Instead, both parties are told not to talk to each other at all and the lawyers handle everything. This usually results in long drawn out cases that can get very expensive for both sides.

When settling disputes through legal mediation you can choose not to directly communicate with the opposing party and this doesn’t affect the outcome. The mediator can deal with both sides separately and still come to a resolution in a timely manner.

Another great thing about legal mediation is that it can be settled with a binding legal agreement that both parties must abide by. If for some reason one party breaks the agreement, this will work in the favor of the other party if the case eventually does wind up as a formal litigation
